Frequently asked questions

What is a KYC questionnaire?

It is the form a regulated business asks a new customer to complete before opening a relationship. It collects identity details, ownership, the purpose of the relationship, the source of funds and declarations on PEP status and sanctions, together with supporting documents.

What is the difference between KYC and CDD?

KYC (know your customer) is the everyday name. CDD (customer due diligence) is the legal term. It covers identifying and verifying the customer, finding the beneficial owners, understanding the purpose of the relationship and monitoring it over time.

When do I need enhanced due diligence?

Whenever your risk assessment shows higher risk, and always for politically exposed persons and for business involving high-risk third countries. Enhanced measures include source of wealth, senior management approval and closer monitoring.

Who counts as a beneficial owner?

Any natural person who owns or controls 25% or more of a company, directly or through other companies, or controls it by other means. For trusts it is the settlor, trustees, protector, beneficiaries and anyone else with ultimate control.

If the customer says they are not sanctioned, do I still need to screen?

Yes. The declaration in the form does not replace screening the customer, the beneficial owners and the directors against sanctions lists. Keep the screening result with the questionnaire.

Is this legal advice?

No. The questionnaire is general information based on the published rules. Adapt it to your own risk assessment and to the requirements of your supervisor.
